Macro Trends and Distressed Debt in Energy

In this webinar, our accomplished presenters analyze and explain recent trends in the oil and gas industry and how they are impacting energy related debt. They discuss the options available to attorneys and their clients when the debt is distressed, including bankruptcy and alternatives. The presenters also examine oil and gas lease considerations, reserve-based loan considerations, decommissioning liabilities, plugging & abandonment liability, and financial assurance. 

Michael Bui, FTI Consulting, Inc.

Michael Bui is a Managing Director in the Turnaround & Restructuring practice. He has more than 12 years of corporate recovery, corporate finance and financial advisory experience. His industry experience includes engineering and construction, oilfield services, exploration and production, power and other industrial sectors.

Mr. Bui’s experience includes forecast and liquidity assessments, business plan development and analyses, collateral evaluations and financial modeling. He has also advised clients on covenant negotiations, bankruptcy preparation, acquisitions and market assessment. Mr. Bui has represented private and public companies, as well as lenders.

Marcella Burke, King & Spalding LLP

Marcella Burke leads King & Spalding’s energy transition initiative and our offshore decommissioning practice. Marcella joins King & Spalding’s from the U.S. Department of Interior where she managed the offshore and onshore decommissioning litigation and regulatory docket. She served as Deputy Solicitor for Energy and Natural Resources, and Senior Counselor to the Assistant Secretary for Land and Minerals Management. Her clients were BOEM, BSEE, BLM, and OSMRE. She served as Counsel to the Royalty Policy Committee, on the Regulatory Reform Task Force, and as NEPAteam lead for all energy-related NEPAapprovals. She also served as Deputy General Counsel of the Environmental Protection Agency.

David B. Lerman, FTI Consulting, Inc.

David is a Managing Director in the Disputes Advisory Services practice within the Forensic & Litigation Consulting segment. He is a Licensed Professional Engineer and Certified Valuation Analyst with more than 30 years of experience working within and consulting to the energy and chemical industries. 
David’s testifying and consulting services include economics, valuations, operations, financial damages and expert witness services. His economic and valuation experience includes estimating royalties from production, damages and lost profits from business interruptions, insurance claims, contract disputes, construction disputes, antitrust matters and other commercial disputes. In addition, David has conducted rigorous commodity market and price analyses for commodity price and royalty disputes. He also assists clients with business valuations to support M&A activities and shareholder disputes.
David has been retained by energy and technology companies in the oil & gas industries, EPC service industries, oil field service industries, oil field equipment industries, transportation & logistics industries, refining and processing industries, chemical industries and power generation industries.
Prior to becoming a consultant, David spent eleven years at Amoco Corporation (now known as BP) where he held assignments in plant operations, R&D, supply chain planning, capital planning, environmental compliance and profitability improvement.

Aaron Terry, FTI Consulting, Inc.

Aaron Terry specializes in cash flow forecasting, liquidity management, upstream and midstream valuations and financial modeling. Mr. Terry has experience in investing, and consulting services, including advising clients on DIP sizing, bankruptcy preparation and various acquisition opportunities. More than half of Mr. Terry’s 20 year career has been dedicated to the energy industry, representing public and private energy companies and lenders within the exploration and production and energy services industry segments.

Mr. Terry has spent the last ten years working in senior research roles within Kayne Anderson’s marketable securities team, focusing on the energy industry. In this capacity, Mr. Terry actively covered more than$1 billion of upstream and midstream equities, helping to manage a broader portfolio of approximately $20 billion in peak energy investments. 

Mr. Terry's research experience covered an extensive portion of the North American energy complex, spanning upstream and midstream companies across all major U.S. basins and Western Canada. He led the upstream diligence of several significant PIPE investments, highlighted by over $500 million of investments in Western Gas and Rice Midstream.

Matthew Warren, King & Spalding LLP

Matthew Warren is a finance partner in King & Spalding’s Chicago office, advising clients on restructuring matters with a particular emphasis on distressed debt and insolvency issues. Mr. Warren represents lenders and bondholders, as well as companies, in connection with restructuring and insolvency related matters.
Mr. Warren advises lenders and bondholders in maximizing recoverable value and helps distressed companies navigate through difficult circumstances based on a sophisticated sense of market practice and extensive experience with complex and challenging scenarios.
He has been recognized for his work in Bankruptcy and Restructuring by Chambers USA 2019 and the publication Turnarounds & Workouts named him a 2018 Outstanding Young Restructuring Lawyer.
