Practical Considerations in Structuring Alternative Financing Transactions for Upstream Producers

This webinar will provide an overview of alternative financing transactions. The three panelists will discuss best practices in documenting alternative financing transactions and the importance of mitigating associated insolvency risk and commodity price volatility. They will also cover an examination of VPPs, ABS and ORRIs as well as the treatment of such instruments in a bankruptcy proceeding involving the grantor, particularly an action in bankruptcy to recharacterize the transaction.
Omar J. Alaniz, Reed Smith LLP
Omar Alaniz is a partner in Reed Smith's Dallas and Houston offices (at the time of the webinar he was a partner at Baker Botts L.L.P. Omar’s diverse, complex chapter 11 practice includes representation of debtors, creditor committees, equity holders, joint venture partners, preference and fraudulent transfer plaintiffs and defendants, and other key stakeholders. He has appeared in bankruptcy and appellate courts throughout the country, including the Texas and United States Supreme Courts. He is the former Chair of the Bankruptcy Section of the Texas State Bar and is a current board member of the Dallas Hispanic Law Foundation. He was a law clerk to former bankruptcy judge D.
