Within days of taking office, President Trump signed executive orders eliminating affirmative action in employment and directing government agencies to root out and end “illegal DEI” in the private sector. President Trump’s orders have given rise to great uncertainty about the legality of workplace DEI programs, and more broadly about their continuing viability. This CLE contextualizes the current moment of uncertainty by examining the history of workplace DEI efforts in the United States and analyzing current case developments relating to legal challenges leveled against employer-sponsored DEI programs, initiatives, and efforts.
