Royalty Litigation: Recent Decisions, Trends and Cases to Watch

This highly experienced panel will discuss cutting-edge developments in royalty litigation across several major oil and gas producing states. In addition to a survey of recent decisions in various states, the panel will discuss the latest trends in royalty litigation and pending cases presenting interesting and/or novel issues of interest to oil and gas practitioners.

Jane Campbell, Chevron

Jane Campbell is Senior Counsel for Chevron North America Exploration and Production Company ( a division of Chevron U.S.A.) where she has a varied practice. Jane is Chevron’s most senior subject matter expert on matters relating to federal, state and private royalty but also serves as Investigations Coordinator, Advocacy Lead and handles many other special projects. Jane is also a member of the Chevron Law Function Diversity Council. Prior to joining Chevron in 2012, Jane worked at ExxonMobil and in private legal practice. She holds a B.A. Honors (Music) from the University of Durham (United Kingdom), a J.D. from Texas Tech University (2006) and an LLM (Tax) from Villanova University (2019). In her spare time, Jane is an avid runner who enjoys marathons.© 2021

Stefanie Burt, EQT Corporation

Stefanie Burt is Assistant General Counsel at EQT Corporation, where she manages the company’s litigation docket and provides counsel on litigation risk and avoidance, pre-litigation claims, and indemnity and insurance. Prior to joining EQT, Stefanie was a partner at Reed Smith.

Robert Sutphin, Holland & Hart LLP

Robert Sutphin is a Partner with Holland & Hart LLP in Santa Fe, New Mexico, where he helps oil and gas producers favorably resolve their most challenging disputes, including royalty underpayment claims, all types of contract disputes, environmental issues, and class actions. 

Robert brings a deep understanding of New Mexico oil and gas law, including insight into issues and problems faced by energy companies. When litigating cases, clients appreciate his tenacity, responsiveness and creativity. This combination of skills and expertise results in consistently good outcomes for his clients. 

He regularly litigates cases involving oil and gas royalties, severance and property taxes, marketing and valuation, allocation and gas balancing, and unit and joint operating agreements. In addition, he handles surface owner disputes, environmental matters, and claims under the Surface Owner’s Protection Act. 

Robert Woods, Yetter Coleman LLP

Robert focuses his practice on complex disputes in the oil and gas industry. Combining substantial litigation experience and substantive industry  knowledge, he regularly handles royalty, lease termination, subsurface  trespass, JOA, processing/gathering agreements, environmental contamination, surface use, and similar issues in a variety of jurisdictions, including Texas, Oklahoma, Pennsylvania, West Virginia, Arkansas, and the Gulf of Mexico. Robert launched prudentoperator.com, a blog providing digestible and relevant commentary on oil and gas litigation and industry current events, and regularly publishes and presents on emerging issues in the oil and gas industry.
