Federal and state agencies, as well as private plaintiffs, have challenged potentially anticompetitive conduct in the energy industry through a variety of methods over the years – including, for instance, through consumer protection laws or novel interpretations of existing statutory or regulatory authority. Our panelists will discuss recent examples of these alternative approaches to policing potentially anticompetitive conduct and provide practical guidance on how to identify and navigate potential challenges.
