The presenters will discuss a trial of a case that began as an Endangered Species Act case but was transformed into an Accommodation Doctrine case. The matter involved a surface owner’s contention that the alleged presence of an endangered animal was a “use” of the surface estate that had to be accommodated by the oil and gas operator.
