Permitting Authority for Carbon Capture and Sequestration Projects: Who has it? Who wants it? What does it take to get it from EPA?


Carbon capture and sequestration (CCS) may be on the cusp of a breakthrough, as recent developments at the federal and state levels suggest strong industry and political support for new CCS projects. To that end, the panel will dive into the Underground Injection Control (UIC) primacy process under the Safe Drinking Water Act (SDWA), why states would want to assume primacy for Class VI wells from the U.S. Environmental Protection Agency, and share their thoughts on the legal, regulatory, and policy dynamics that may clear, or impede, a path for CCS execution.
